Regulating Big Tech: From Competition Policy to Sector Regulation?

The European Commission has proposed a new regulatory tool for the governance of digital markets. Digital Markets Act (DMA) intents to limit market behavior so-called gatekeeper companies ensure contestable and fair We review provisions DMA both from legal an economics perspective. Notwithstanding number benefits, we identify several issues with current proposal. When looking at core proposal economic perspective, five contention arise: many seem be quite narrow in scope it seems difficult extrapolate more general rules them; harm some is uncertain principle debatable; alleged distinction between different types obligations cannot verified, and, last but not least, while seeks control existing gatekeepers, “tipping” markets rise further gatekeepers guaranteed by this proposal; turn leads larger critical analysis as DMA’s norm addressee. From first hurdle lack clarity pertaining nature goals DMA, compounded procedural enforcement regime uncertainties loopholes – all which tend undermine intended stringency regulation its overall chances making systemically fairer. Thus, think that reform competition policy would better suit need regulating big tech.
